Terms of Service

1. Acceptance of Terms

By accessing or using Nightwalls ("the Service"), operated by Moklabs ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

Nightwalls is an AI-powered security monitoring application that connects to your cameras (via RTSP, ONVIF, or MJPEG protocols) and uses computer vision to detect security events in real time, including intrusions, fire, theft, and violence. The Service provides alert notifications through channels such as Telegram and ntfy.sh.

3. Acceptable Use

You agree not to use Nightwalls to:

  • Monitor, record, or surveil individuals without their informed consent or without complying with applicable local, state, national, or international laws.
  • Engage in any form of stalking, harassment, or invasion of privacy.
  • Use the Service in any way that violates any applicable law or regulation.
  • Attempt to reverse-engineer, decompile, or disassemble the Service.
  • Use the Service for any purpose that is unlawful or harmful to others.
  • Circumvent, disable, or interfere with security features of the Service.

4. AI Classification Disclaimer

The Service uses artificial intelligence, including Google Gemini Vision API, to classify and detect security events. You acknowledge and agree that:

  • AI classification results are probabilistic and are not guaranteed to be 100% accurate.
  • False positives (detecting an event that did not occur) and false negatives (failing to detect an event that did occur) may occur.
  • Nightwalls should be used as a supplementary monitoring tool and does not replace professional security systems or human judgment.
  • We are not liable for any loss, damage, or harm arising from inaccurate AI classifications or missed detections.

The Service integrates with third-party services. Your use of these services is subject to their respective terms and privacy policies:

You are solely responsible for:

  • Ensuring that your use of cameras and monitoring complies with all applicable privacy and surveillance laws.
  • Securing your Nightwalls instance, API keys, and credentials.
  • Any content or data you transmit through the Service.
  • Notifying individuals being monitored where required by law.

7. Intellectual Property

The Service, including its software, design, logos, and documentation, is owned by Moklabs and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from the Service without our prior written consent.

8. Limitation of Liability

To the maximum extent permitted by applicable law:

  • The Service is provided "as is" and "as available" without warranties of any kind, either express or implied.
  • We do not warrant that the Service will be uninterrupted, timely, secure, or error-free.
  • In no event shall Moklabs be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or use, arising from or related to your use of the Service.
  • Our total liability shall not exceed the amount you have paid to us in the twelve (12) months preceding the claim.

9. Indemnification

You agree to indemnify and hold harmless Moklabs and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service or your violation of these Terms.

10. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service will immediately cease.

11. Changes to These Terms

We may update these Terms of Service from time to time. We will notify you of material changes by posting the updated terms on this page with a revised "Last updated" date. Your continued use of the Service after changes are posted constitutes acceptance of the revised terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Brazil, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Brazil.
